terms and conditions

This is an exciting time for you. The beginning of any project is a mix of excitement and nervous anticipation. Clear communication will be important for the duration of this entire project and beyond. This information package was developed specifically for you to become familiar with our processes and our promises to you and to minimize any surprises before, during or after construction.

We’re humbled by the trust you’ve placed in us because we understand that trust is earned. We are constantly evaluating our work to ensure that we maintain the great reputation we have worked hard to achieve over the past 25 years in the industry.

1. A one-year, one-time replacement* warranty for all plant material.

Plants create an inspiring environment that you’ll want to spend time in. And they’re good for you! They just need to be cared for. We take full responsibility for choosing plants that will thrive in your particular location and for getting the plants we install properly adjusted to their new environment.

It is the responsibility of the home owner to ensure the plants thrive by providing adequate watering and maintenance. Please refer to the client care package section on our website for helpful information on caring for your gardens or contact your sales person to find out more about our lawn and garden care services.

Please note that specific plant selections, numbers, and sizes are subject to substitution without notice should stock become unavailable, in which case the most suitable substitution will be made by a CSLG representative.

CSLG does not replace or warranty sod.

2. A 3-year warranty on all workmanship.

We want our work to stand the test of time so that you can simply enjoy your new landscape, not worry about it.

Regardless of the complexity of the installation, we offer our clients a 3-year warranty on all our landscape installations. All warranty work will be completed in a timely fashion provided the initial contract payments are paid in full.

3. Public Utility locates – we’ll take care of it.

To increase the safety of our employees, and to avoid any unnecessary expense, we will contact all public utility companies (telephone, cable, gas, hydro, etc.) prior to construction.

4. Private utilities, permits and property lines – that would be you.

We take great care in our design process to understand your local by-laws and permit requirements. It remains the responsibility of the home owner to ensure all permits required are in place prior to construction. We are very familiar with this process and happy to help you through it.

We will inform you in advance about any permits required by your local municipality or conservation authority of which we are aware. If permits are required we can also help with the development of permit drawings and with the processes of receiving approvals ($125.00 per hour plus the actual municipal permit fee). Please inform us of any official property line demarcation, any private utilities, septic systems or wells. We will not be responsible for any claims or damage during construction if this information is not provided to us prior to our arrival.

Please be aware that in most circumstances we are unable to avoid damage to any irrigation or lighting systems that might currently exist within the planned work area. Repairs to these systems or any alterations or upgrades required to accommodate the new landscape installation will be at the expense of the home owner (unless include in the scope of work outlined in the contract).

All electrical work, 120Volt (exterior GFI plugs, switches, junction box, ceiling fans…etc.) will need an electrical inspection from the Electrical Safety Authority. A minimum fee of $240.00 will be applied.

5. We’re fully insured.

Construction can be dangerous. We constantly review safety practices and train our employees to work safely. Unfortunately accidents can, and do, still happen.

Cedar Springs Landscape Group carries insurance for public liability and property damage. This is for your benefit as well as ours. We also provide coverage for all of our employees through the Workers Compensation Insurance Board.

6. No unnecessary delays.

We know how important it is to you that your project is completed on time. We’ll plan your project meticulously to ensure this. When things beyond our control (i.e.: adverse weather, delayed material, strikes, etc.) cause delays we promise to review the schedule and communicate with you about any impact these delays may have on timelines.

7. We’ll tell you about any unplanned changes immediately.

Your property may hold a few surprises. Hidden rocks, tree trunks, foundations, wells, septic tanks can add complexity and cost to the construction process.

Excavation costs, disposal costs, or other associated costs will be considered extras to the contract. We will bring this to your attention immediately.

8. Here are some other things we can’t control.

We constantly evaluate and source the best products to meet the needs of our clients and their landscape. But we have yet to find a perfect product that is not affected by the outdoors weather conditions here in Southern Ontario.

Here are some possible imperfections we would like you to be aware of prior to installation: Staining, discolouring, efflorescence, cracking, and chipping.

These changes may occur on wood, poured-in-place concrete, precast concrete, asphalt, natural stone, concrete pavers or brick as a result of climate/weather or by de-icing salts or other products which may be applied after installation.

Any minor cracking from shifting or settlement for poured-in-place plain, patterned, or exposed aggregate reinforced concrete is not warranteed. A differential shifting of plus or minus one inch in one direction from the true line is common. Any touch-ups or repairs are considered a service item and billable. Patterned and exposed aggregate concrete requires resealing within a two-year period, which is not warranteed but recommended and is considered normal maintenance to protect the integrity of surface treatment.

The owner/client acknowledges that there may be a slight variation in colour between the colour samples shown and the actual colour of the material installed due to manufacturing times or natural processes. If the contracted material pattern, colour, or sizing changes at the request of the client and requires re-ordering or return of material, there will be a restocking charge equal to 30% of the material value.

9. A word about pressure-treated lumber.

We have discovered that the best use for Pressure Treated Lumber is for sub-structure purposes but not where detailed, fine carpentry is required.

Pressure Treated lumber is an excellent, and very common construction product. It’s been used for decades and likely will continue to be a useful product for years to come. However, it ages poorly – meaning warping, significant cracking and splintering. We do not recommend Pressure Treated for deck surfaces, and will not guarantee the material for use as a finished product (i.e.: fences, screens, etc.).

10. We’ll stick to the plan.

Landscape construction is a costly endeavour. We believe that all costs (and potential costs) should be clearly communicated with you prior to signing the contract. In addition, a payment schedule should be reviewed and approved. The only surprise we want you to have is with the quality of the work. It’s important for the success of the project that once we approve the plan we stick to it.

If a scheduled payment is not received within a week after it has been requested, work on the project will discontinue and an emergency meeting with the client will be requested to determine how we move forward. Please be aware, that although certain areas within the landscape may be completed well in advance of the finalized project (separate phases not included), the warranty of our installed products does not take effect until the whole planned project is complete and full payment for the installation has been received.

If you should choose to terminate your contract or abandon the project at any state of completion over the duration of contracted work we expect to be compensated for services performed and material purchased up to the point of notification.

11. Oh… and we’ll want to take your picture ☺

We take pride in our work and keep a record of all our projects. We also use images of completed projects for training and promotion purposes.

We’ll photograph the project site at times, before and during the construction. Some time after we complete the work at your home, we may contact you to arrange a day to professionally photograph the project. We respect that your home is a private place and therefore we will contact you to receive your permission prior to any arrangements of this nature.
